The Preface to the Ninth Edition described my approach to structure and content in detail. That preface appears in the immediately following pages.
Although the
book's organization is unchanged, much of its content is new.
The past six years of constitutional law have been lively and important ones, and the literature in the field has been voluminous. These developments, as well as modifications in my own analyses, have required a rethinking of recurrent problems and the inclusion of many new ones. Constitutional law today is in a state of flux, prompted in large part by the changes in the composition of the Court since the last edition.
William H. Rehnquist has succeeded Warren E. Burger as Chief Justice;
Justices Lewis F. Powell, Jr., and William J. Brennan, Jr., have also retired; and Justices Antonin Scalia, Anthony M. Kennedy, and David H.
Souter are the newest members of the Court.
The impact of these
appointments by Presidents Reagan and Bush is increasingly evident.
Taking account of these developments- some already accomplished, others still emerging- has required much new writing, not only with respect to Court decisions but also about related developments in Congress and other lawmaking bodies (as with the congressional efforts to respond to the flag-burning cases and the proliferation of campus regulations aimed at "hate speech'").
